Estate Planning

     Schwartz & Associates offers a broad range of estate planning services. We prepare customized estate planning documents, including wills, revocable trusts, durable powers of attorney for property management, and advance health care directives. We also design, implement, and administer estate and gift tax reduction techniques, such as limited liability companies, family gifting, marital deduction trusts, qualified personal residence trusts and other types of grantor retained interest trusts, life insurance trusts, charitable remainder trusts and other planned giving strategies.

Estate Administration

     Schwartz & Associates represents beneficiaries, fiduciaries (executors, trustees, personal representatives), and other interested persons in all aspects of probate and trust administration, including the administration of decedents' estates through probate or through revocable trusts.

     With our extensive experience in administering estates and trusts, Schwartz & Associates is prepared to assist clients in the most tax-efficient and beneficial ways to fulfill the terms of the governing document.

     We assist clients in administering estates and trusts immediately from inception. When clients pass away, we begin assisting family members, beneficiaries and fiduciaries to ensure that they are advised of their rights and obligations and that the estate is properly, efficiently and promptly administered. In the course of representing estates, we probate the Will (or commence an intestacy administration proceeding if there is no Will), if required by the estate plan. We also help to marshal, preserve and value all of the decedent's assets. Where necessary or appropriate, we advise clients regarding potential and actual litigation regarding estate, trusts and related matters. Upon completion of an estate or a trust administration, we assist in preparing an accounting, work with the fiduciaries to settle the account and secure the fiduciaries release from liability, with or without court action, depending upon the circumstances.

Real Estate Law

     Schwartz & Associates provides a wide array of services in the practice of real estate law. We represent owners, developers, tenants, contractors and architects in connection with real estate transactions involving the purchase, development, leasing, financing and sale of commercial, retail and residential property.

     In addition, Schwartz & Associates represents commercial landowners, builders, contractors, landlords, real estate brokers and agents, and other parties in matters involving real estate contract disputes, options contracts and construction defects.

     Our firm’s real estate practice also relates to our practice in estate planning, trusts and estates, and asset protection. Because real estate is such an integral part of many clients’ estates, creating an estate plan usually requires restructuring of the ownership of the real estate. The services our attorneys provide on the transactional aspects of real estate work dove tails with the administration of decedents’ estates, when the sale of the real estate is often necessary.

     Schwartz & Associates also welcomes and regularly represents “stand-alone” real estate clients who are initially seeking representation in only specific transactions, such as a house purchase or sale, or drafting or negotiating an office lease.

Business Law

     Schwartz & Associates’ attorneys assist and advise business owners in forming and operating all forms of business entities. This includes transactional assistance, and executive compensation planning for limited liability companies, privately held corporations and partnerships. We serve as outside general counsel for businesses as well as counsel for particular business transactions to small and medium-sized closely held companies that emerge as start-ups and grow into mature companies.

     We provide advice and counsel in connection with corporate governance, the legal risks and benefits of transactions, on-going operations and strategy. We approach business issues with a view towards providing value, understanding our client’s business and applying extensive experience to find solutions to our clients' challenges. We work closely with our clients to create highly personalized business plans, which we help execute through drafting, negotiating, and ongoing consultation.
